@article{พลสิงห์_2014, title={มาตรการภาษีในการบริหารจัดการพิพิธภัณฑ์ท้องถิ่น (Taxation Measures in the Management of Local Museums)}, volume={4}, url={https://e-journal.sru.ac.th/index.php/jhsc/article/view/57}, abstractNote={<p><span>การวิจัยนี้มีวัตถุประสงค์เพื่อศึกษา มาตรการภาษีในการบริหารงานพิพิธภัณฑ์ท้องถิ่นประเภทต่างๆ ตามหน่วยภาษี 3 รูปแบบ คือ บุคคลธรรมดาหรือคณะบุคคล สมาคมหรือมูลนิธิ และสมาคมหรือมูลนิธิที่ได้รับการประกาศเป็นองค์การสถานสาธารณกุศลตามมาตรา 47 (7) (ข) แห่งประมวลรัษฎากร โดยศึกษาภาษีเงินได้ ภาษีมูลค่าเพิ่ม ภาษีโรงเรือนและที่ดิน ภาษีบำรุงท้องที่ และภาษีป้าย เพื่อเสนอแนวทางการปรับปรุงและเพิ่มเติมกฎหมายอย่างสมเหตุสมผลต่อการบริหารงานพิพิธภัณฑ์ในประเทศไทย</span><br /><span>วิธีการศึกษา นำบัญชีการเงินของพิพิธภัณฑ์ที่จดทะเบียนเป็นองค์กรไม่แสวงผลกำไร โดยคัดเลือกพิพิธภัณฑ์ที่มีการดำเนินงานอย่างต่อเนื่อง เป็นที่รู้จักในสังคม มีการเสียภาษีและจัดทำบัญชีอย่างถูกต้องมาคำนวณเงินภาษีที่ต้องชำระตามหน่วยภาษีทั้ง 3 รูปแบบ จากนั้นจึงเปรียบเทียบความแตกต่างของจำนวนเงินภาษีและสิทธิประโยชน์ต่างๆ เพื่อวิเคราะห์ปัญหาพร้อมนำเสนอแนวทางที่เหมาะสมด้วยการสัมภาษณ์ผู้มีประสบการณ์ด้านพิพิธภัณฑ์ ด้านบริหารจัดการและด้านภาษีอากร</span><br /><span>ผลการศึกษา พบว่า รัฐจัดเก็บภาษีจากพิพิธภัณฑ์ตามหน่วยภาษีในการจดทะเบียน โดยพิพิธภัณฑ์ที่จดทะเบียนภายใต้องค์กรธุรกิจมีหน้าที่ชำระภาษีเสมือนการประกอบธุรกิจ ส่วนพิพิธภัณฑ์ที่จดทะเบียนภายใต้องค์กรไม่มุ่งแสวงผลกำไรมีหน้าที่ชำระภาษีตามองค์กรที่ได้จดทะเบียนไว้ทำให้พิพิธภัณฑ์ท้องถิ่นถูกจัดเก็บภาษีแตกต่างกันดังนี้ ภาษีเงินได้ พิพิธภัณฑ์ที่ดำเนินงานโดยบุคคลธรรมดาหรือคณะบุคคลเสียภาษีเงินได้แบบอัตราก้าวหน้า ส่วนพิพิธภัณฑ์ที่ดำเนินงานโดยสมาคมหรือมูลนิธิเสียภาษีแบบอัตราคงที่แต่ไม่สามารถนำต้นทุนมาหักค่าใช้จ่ายได้ และพิพิธภัณฑ์ที่ดำเนินงานโดยสมาคมหรือมูลนิธิที่ได้รับการประกาศเป็นองค์การสถานสาธารณกุศลมาตรา 47 (7) (ข) แห่งประมวลรัษฎากรไม่ต้องเสียภาษีเงินได้ ภาษีมูลค่าเพิ่มการประกอบกิจการพิพิธภัณฑ์ได้รับ ยกเว้นภาษีมูลค่าเพิ่ม ตามมาตรา 81(1)(ฏ) แห่งประมวลรัษฎากรไม่ต้องจดทะเบียนภาษีมูลค่าเพิ่ม (ตามแนววินิจฉัยของกรมสรรพากร ได้รับการยกเว้นเฉพาะค่าเข้าชม) ภาษีโรงเรือนและที่ดินไม่ได้รับการยกเว้นภาษี ภาษีบำรุงท้องที่ ไม่ได้รับการยกเว้นภาษี และภาษีป้ายพิพิธภัณฑ์ที่ดำเนินงานโดยบุคคลธรรมดาหรือคณะบุคคลไม่ได้รับการยกเว้นภาษี แต่พิพิธภัณฑ์ที่ดำเนินงานโดยสมาคมหรือมูลนิธิ และสมาคมหรือมูลนิธิที่ได้รับการประกาศเป็นองค์การสถานสาธารณกุศลตามมาตรา 47 (7) (ข) แห่งประมวลรัษฎากรได้รับการยกเว้นภาษีป้าย</span><br /><span>ด้วยมาตรการและสิทธิประโยชน์ดังกล่าวก่อให้เกิดปัญหาอันเป็นอุปสรรคในการบริหารงาน ได้แก่ ปัญหาการมีสถานะเป็นองค์การสถานสาธารณกุศลโดยการถาวร ปัญหาการขอมีสถานะเป็นองค์การสถานสาธารณกุศลตามมาตรา 47 (7) (ข) แห่งประมวลรัษฎากร ปัญหาภาษีมูลค่าเพิ่มกับการจำหน่ายสินค้าและการบริจาค ปัญหาเรื่องการจำกัดวิธีบริจาค ปัญหาสิทธิประโยชน์จากการบริจาค ปัญหาการจัดเก็บภาษีโรงเรือนและที่ดิน ภาษีบำรุงท้องที่ และภาษีป้าย โดยมีข้อเสนอเพื่อเพิ่มเติมมาตรการภาษี คือ มาตรการทางภาษีเพื่อเป็นแรงจูงใจในการจัดตั้งพิพิธภัณฑ์ที่ได้รับมาตรฐานสากล เพื่อส่งเสริมการบริจาคแก่พิพิธภัณฑ์ เพื่อส่งเสริมการเข้าชมพิพิธภัณฑ์ เพื่อส่งเสริมผู้ประกอบการพิพิธภัณฑ์ท้องถิ่น และเพื่อส่งเสริมพิพิธภัณฑ์เอกชนเป็นผู้ประกอบการสังคม</span></p><p>The purpose of this research is to study the criterion of local museum’s<br />taxation management that consists of 3 systems: 1) Individual or Group of persons (sic) 2) Association or Foundation and 3) Association or a Foundation that has been declared a public charitable organization in accordance with Section 47 (7) (b) of the Revenue Code. The study of income tax, value-added tax, house-and-building tax, local development tax, and the signboard tax was taken into account when presenting ways of improvement and for creating reasonable regulations for the good of museum management in Thailand.</p><p>    The method of this study is to bring from the non-profit museums’<br />financial accounts and then choosing the museums that have continuously been<br />administered, are well-known, have been paying tax and have properly managed their financial affairs to calculate the taxes that have to be paid in accordance with the aforementioned 3 tax entities. Then, the researcher compared and contrasted the differences between the tax money and benefits and analyzed the problems in order to come up with suitable alternatives by interviewing people who are knowledgeable about museums and experts in both museum management and taxation.</p><p>  The museums that are registered as corporate businesses are responsible for tax payments just like other privately-owned firms. As for those museums that are registered as non-profit organizations, they are responsible for tax payments similar to those of other registered non-profit organizations. However, they differ from each other in the following ways:</p><p>  1. Income tax: the museums that are being operated by individual or group of persons (sic) have to pay tax at the same progressive rate as for the personal income tax system. Those museums that are being operated as an association or foundation are liable to pay tax based on the flat rate system and that the cost cannot be deducted from their expenses. Also, those museums that are being operated as an association or foundation that has been declared to be a public charitable organization in accordance with Section 47 (7) (b) of the Revenue Code will be exempt from income tax.</p><p>   2. Value-added-tax: Except for the entrance fee, a museum business is<br />exempt from value-added-tax. According to section 81 (1) (l) of the Revenue<br />code, a museum business needs no value-added-tax registration.<br />   3. Signboard tax: the museums that are being operated by individual or<br />group of persons (sic) will not be exempt from taxation, but the museums that<br />are being operated as an association or foundation, and those museums that are<br />being operated as an Association or Foundation that has been declared a public<br />charitable organization in accordance with Section 47 (7) (b) of the Revenue<br />Code will be exempt from signboard tax.<br />  4. Local museums are not exempt from House-and-building tax and<br />Local development tax. Such criteria and benefits have caused several issues and problems in terms of administration and management. These consist of; the issue of being a permanent charitable organization, the issue of the request to be a charitable organization in accordance with Section 47 (7) (b) of the Revenue Code, the issue of value-added tax products distribution and donations, the issue with monetary methods of donation, the issue with the benefits from donations, or the issue of collecting house-and-building tax, local development tax, and signboard tax. Having listed all the issues, there is actually an additional suggestion for the criterion of taxation, which is, the criterion of taxation that motivates businessmen to standardize their museums to be internationally and universally accepted.
