การตีความกฎหมายอาญา : คดีดูหมิ่นผู้อื่นซึ่งหน้า โดยการใช้โทรศัพท์ (Interpretation of Criminal Law: Abuse Case by Using Telephone)

Abstract

บทความนี้ผู้เขียนได้นำคำพิพากษาศาลฎีกาที่ตัดสินเกี่ยวกับคดีดูหมิ่นผู้อื่น
ซึ่งหน้าโดยการใช้โทรศัพท์ ซึ่งตัดสินในปี พ.ศ. 2556 กับที่ตัดสินในปี พ.ศ. 2557 ในกรณี
เดียวกัน โดยที่ ในปี พ.ศ. 2556 ตัดสินให้มีความผิด ส่วนในปี พ.ศ. 2557 ตัดสินให้ยกฟ้อง
มาศึกษาวิเคราะห์ ตีความ และเปรียบเทียบ เพื่อนำผลที่ได้มาใช้เป็นแนวทางในการ
พิจารณาคดีลักษณะนี้ต่อไปในอนาคต และเพื่อเป็นการป้องปรามผู้ใช้โทรศัพท์มิให้ใช้
เป็นสื่อในทางก่อให้เกิดความเสียหายแก่ผู้อื่น จากการศึกษาดังกล่าว ผู้เขียนเห็นว่า
คำตัดสินของศาลฎีกาในปี พ.ศ. 2556 ที่ตัดสินให้มีความผิด น่าจะใช้เป็นแนวทางและ
ป้องปรามได้ เพราะคำตัดสินเช่นนี้เป็นการชี้ให้เห็นความผิด และเป็นความผิดที่ต้องได้รับ
ผลตอบแทนอันจะทำให้ผู้ใช้โทรศัพท์เกิดความระมัดระวังในการสื่อสารกับบุคคลอื่นต่อไป

This article is written to introduce the Supreme Court judgments
concerning insulting the other person in his presence via telephone. The
judgments were released in 2556 B.E. and 2557 B.E., while the judgment in
2556 B.E. considered as an offense, the judgment in 2557 B.E. dismissed. The
writer analyzed, interpreted and compared these judgments to show the pattern
for consideration this kind of case in the future. It will also suppress telephone
users from misconducts. From the research, the writer believed that the
judgment in 2556 B.E. which pronounced as guilty will be a guideline and a
suppression because it pointed out faults and punishment that will cause the
awareness of telephone users in communicating with others.
