การเข้าถึงและความคาดหวังของคนพิการต่อสิทธิประโยชน์ ในมาตรา 20 แห่งพระราชบัญญัติส่งเสริมและพัฒนาคุณภาพชีวิต คนพิการ พ.ศ. 2550 และที่แก้ไขเพิ่มเติม (ฉบับที่ 2) พ.ศ. 2556 : กรณีศึกษากรมส่งเสริมและพัฒนาคุณภาพชีวิตคนพิการ (Accessibility and Expectation of the)

Abstract

การศึกษา เรื่อง การเข้าถึงและความคาดหวังของคนพิการต่อสิทธิประโยชน์
ในมาตรา 20 แห่งพระราชบัญญัติส่งเสริมและพัฒนาคุณภาพชีวิตคนพิการ พ.ศ. 2550
และที่แก้ไขเพิ่มเติม (ฉบับที่ 2) พ.ศ. 2556 : กรณีศึกษากรมส่งเสริมและพัฒนาคุณภาพชีวิต
มีวัตถุประสงค์เพื่อศึกษาการเข้าถึงและความคาดหวังสิทธิประโยชน์ตามมาตรา 20 ของ
คนพิการ เพื่อนำไปสู่แนวทางการส่งเสริมสิทธิประโยชน์สำหรับคนพิการตามมาตรา 20
ระเบียบวิธีการศึกษา เป็นการศึกษาเชิงพรรณาโดยใช้การสำรวจกลุ่มตัวอย่างที่ใช้
ในการศึกษา คือ คนพิการทุกประเภทที่มีบัตรประจำตัวคนพิการที่มาใช้บริการ ณ กรม
ส่งเสริมและพัฒนาคุณภาพชีวิตคนพิการ จำนวน 140 คน การวิเคราะห์ข้อมูลใช้
คา่ รอ้ ยละ ค่าเฉลี่ย และค่าส่วนเบี่ยงเบนมาตรฐาน

ผลการศึกษา พบว่า กลุ่มตัวอย่างส่วนใหญ่เป็นเพศชาย อายุระหว่าง 11 - 20 ปี
จบการศึกษาระดับประถมศึกษา และไม่ได้ประกอบอาชีพ มีบัตรประจำตัวคนพิการ
มาแล้วมากกว่า 4 ปี ผลการศึกษาระดับการเข้าถึงสิทธิของคนพิการตามมาตรา 20 พบว่า
อยู่ในระดับน้อย เมื่อพิจารณาเป็นรายด้าน พบว่า การจัดสวัสดิการเบี้ยความพิการ การ
ยอมรับและมีส่วนร่วมในกิจกรรมทางสังคม และบริการล่ามภาษามือ เป็นสิทธิที่คนพิการ
เข้าถึงมากที่สุด ในขณะที่สิทธิด้านการปรับสภาพแวดล้อมที่อยู่อาศัย และการมีผู้ช่วย
คนพิการ การฟื้นฟูสมรรถภาพด้านอาชีพ และการช่วยเหลือให้เข้าถึงนโยบาย โครงการ
และการช่วยเหลือทางกฎหมาย เป็นสิทธิที่คนพิการเข้าถึงน้อยที่สุด สำหรับระดับความ
คาดหวังของคนพิการต่อสิทธิประโยชน์ มาตรา 20 อยู่ในระดับมาก เมื่อพิจารณารายด้าน
พบว่า การจัดสวัสดิการเบี้ยความพิการ การรับข้อมูลข่าวสาร และการสื่อสาร และการ
ยอมรับและมีส่วนร่วมในกิจกรรมทางสังคม เป็นสิทธิที่คนพิการคาดหวังมากที่สุด ในขณะ
ที่การช่วยเหลือให้เข้าถึงนโยบาย โครงการและการช่วยเหลือทางกฎหมาย การศึกษา และ
การปรับสภาพแวดล้อมที่อยู่อาศัย และการมีผู้ช่วยคนพิการ เป็นสิทธิที่คนพิการคาดหวัง
น้อยที่สุด ทั้งนี้ ความต้องการและแนวทางพัฒนาสิทธิประโยชน์ของคนพิการ คือ ควรมี
จุดบริการคนพิการตามจุดต่าง ๆ ให้ครอบคลุมทุกพื้นที่เพื่อความสะดวกในการใช้บริการ
ทั้งควรเพิ่มช่องทางการประชาสัมพันธ์ข้อมูลข่าวสารที่เป็นประโยชน์ รวมถึงสิทธิของ
คนพิการให้ลงลึกถึงชุมชน

ข้อเสนอแนะจากการศึกษา คือ กรมส่งเสริมและพัฒนาคุณภาพชีวิตคนพิการ
(พก.) ควรกำหนดนโยบาย / แผน / โครงการในการสร้างระบบและส่งเสริมให้คนพิการเข้า
ถึงสิทธิที่สอดคล้องกับความต้องการของคนพิการ และควรเพิ่มช่องทางการเผยแพร่สิทธิ
หรือข้อมูลที่เป็นประโยชน์กับคนพิการอย่างกว้างขวางทั่วถึงมากขึ้น รวมทั้งควรสร้าง
ความตระหนักให้เจ้าหน้าที่ผู้ทำงานด้านคนพิการเห็นความสำคัญเรื่องสิทธิประโยชน์ของ
คนพิการ ขณะที่องค์กรปกครองส่วนท้องถิ่นควรมีบทบาทมากขึ้นในการส่งเสริมและ
พัฒนาคุณภาพชีวิตคนพิการในระดับพื้นที่ รวมทั้งควรมีการพัฒนาหน่วยงานหลักที่ให้
บริการจัดหาและฝึกทักษะคนพิการให้ตรงตามความต้องการของตลาดแรงงานเพื่อการส่ง
เสริมอาชีพให้คนพิการมากขึ้น

The study on “Accessibility and Expectation of the Disability to the
Rights under Article 20 of Persons with Disabilities Empowerment Act B.E.
2550, and the Revised Second Edition B.E. 2556: A Case Study of Department
of Empowerment of Person with Disabilities” has an aim to study the accessibility
and expectation of the Disability to the Rights under Article 20, in order to find
the solution to promote the rights of disabilities under Article 20. The study
method is a descriptive study by questionnaire on sampled disabilities groups.
The groups used in this study are 140 disabilities with the disability cards that
come to use the service at the Department of Empowerment of Person with
Disabilities. The analysis process has used the percentages, means, and standard
deviation as below;
The result of the study revealed that the sampled groups are mostly male,
at the age between 11 - 20 years old, graduated with primary - school education,
unemployed, and hold the disability card for more than 4 years. The result of
the study found that the accessibility rate of the disabled people under
Article 20 is still low. Considering that, disability premiums welfare, acceptation
and participation in the social activities, and sign language translator are the
rights that most reached by the disabled people. On the other hand, the right
to living environment changing, the assistance for disabled people, the
vocational rehabilitation, the legal assistance and accessing to policy level are
the right that least reached by the disable people. For the expectation level of
the disability to the rights under Article 20 are the rights. Considering that,
disability premiums welfare, the receiving of information and communication,
acceptation and participation in the social activities are rights that most
expected from the disabled people. In the mean time, the assistance to the
policy programs and social activities, legal assistance, education, and living
atmosphere changing are the right least expected by the disabled people. In
this case, the need and ways to improve the rights of disabled people are that 

there should be service points for the disabled people to cover in all areas for
the convenience in receiving the service of disabled people. Also, there should
provide more channels for public relations to provide useful information including
deepening the rights of disabled people in the community.
The suggestions from the study are that the Department of
Empowerment of Person with Disabilities should identify the plan/policy /
program in order to establish the system and promote the disabled people to
be able to access to their rights in accordance with their conditions. The
Department should provide more channel to disseminate useful information for
the disabled people in all areas, including raising the awareness for the officers
whose work related to the disabled people to realize the importance of the
disabled people’s rights. Meanwhile, the local authority should play more roles
in encouraging the better living quality of the disabled people in their areas and
improve the focal organization to manage and train directly the disabled people
in accordance with the need in the labor market to promote career for the
disabled people.
